Terms and Conditions

1. General Applicability These Terms and Conditions constitute a legally binding agreement between the applicant (hereinafter referred to as the "Student") and Ascend Mixed Martial Arts, its owners, directors, instructors, affiliates, and representatives (hereinafter collectively referred to as the "Academy"). By signing the admission form or participating in any training program, the Student (or parent/legal guardian in the case of a minor) expressly agrees to be bound by all clauses mentioned herein.
2. Eligibility and Disclosure The Student affirms that all information provided during admission is accurate and complete. Any false declaration, omission, or misrepresentation may result in immediate termination of enrolment without refund. The Academy reserves the absolute right to accept or reject any application at its sole discretion without assigning any reason.
3. Training and Conduct The Student agrees to abide by all rules, schedules, dress codes, and behavioral guidelines as instructed by the Academy. The Student shall conduct themselves in a respectful, disciplined, and non-violent manner within and outside the premises of the Academy. The Student agrees that all techniques taught are for personal development, self-discipline, and self-defense only, and shall not be used in any unlawful, unethical, or aggressive manner.
4. Limitation of Liability The Student acknowledges and understands that participation in martial arts training involves physical exertion and risk of bodily injury. The Academy, its instructors, staff, and affiliates shall not be held liable or responsible for any injury, illness, disability, death, loss, or damage, howsoever caused, whether during training, while on premises, or while traveling to or from the Academy. The Student assumes full personal responsibility and liability for any and all risks arising from participation.
5. Misuse of Skills If any student uses martial arts skills acquired at the Academy in any external altercation, unlawful activity, or act of aggression that results in injury or harm to another person or property, the Academy shall not bear any responsibility or legal liability. The Academy shall not be party to any criminal, civil, or compensatory proceedings arising from such conduct.
6. Medical Conditions and Fitness The Student affirms that they are medically and physically fit to participate in martial arts training. Any prior medical condition, injury, surgery, allergy, or disability must be disclosed in writing prior to commencement of training. The Academy reserves the right to request a medical certificate of fitness. The Academy shall not be liable for exacerbation of any undisclosed medical condition or injury incurred due to negligence or non-compliance by the Student.
7. Fees and Refund Policy All fees, including but not limited to admission, monthly, quarterly, or annual charges, are strictly non-refundable and non-transferable. Payment must be made on or before the due date. Delay or default in payment may lead to denial of access or termination of enrolment. Discounts or promotional offers, if any, are at the discretion of the Academy and subject to withdrawal without notice.
8. Property and Personal Belongings The Academy shall not be held responsible for loss, theft, or damage to any personal belongings of the Student within the premises. Students are advised not to bring valuables or cash unless necessary.
9. Media Release and Publicity By enrolling, the Student grants the Academy the irrevocable right to use their photographs, video recordings, and testimonials taken during training or events for promotional, commercial, or educational purposes, unless explicitly objected to in writing.
10. Termination and Disciplinary Action The Academy reserves the absolute right to suspend or permanently terminate any student from the training program in case of misconduct, indiscipline, verbal or physical abuse, non-compliance with Academy rules, non-payment of fees, or any act that brings disrepute to the Academy. No refund shall be processed in such cases.
11. Indemnification The Student (or parent/guardian in case of a minor) hereby agrees to fully indemnify, defend, and hold harmless Ascend Mixed Martial Arts, its management, employees, and agents from any claims, liabilities, damages, legal actions, losses, or expenses (including legal fees) arising out of or in connection with breach of these Terms and Conditions, misuse of learned skills, injury to self or others, or property damage caused by the Student.
12. Governing Law and Jurisdiction These Terms and Conditions shall be governed by and construed in accordance with the laws of India. All disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Durgapur, West Bengal.
